Global Scope of Applicability

This Master Legal Framework governs all digital assets, web portals, mobile interfaces, examination systems (including the Ramasukh National AI Olympiad - RNAIO), charitable medical centers, old-age homes, orphanages, subsidized distribution programs, temples, cultural wings, animal welfare services, and all associated physical or virtual operations conducted by or under the auspices of the Foundation.

Binding Legal Contract

This Master Legal Disclaimer and Terms of Use ("Agreement") constitutes a fully binding, legally enforceable contract between you (hereinafter referred to as the "User," "Participant," "Student," "Parent," "Legal Guardian," "Patient," "Beneficiary," "Donor," or "Visitor") and the Ramasukh Foundation of India (U.P.), Lucknow. By accessing, browsing, registering on, downloading from, or interacting in any manner with the official website, portals, or physical/virtual programs of the Foundation, you explicitly, unconditionally, and irrevocably agree to comply with and be bound by every term, condition, covenant, and disclaimer contained herein. If you do not agree with any single clause, provision, or limitation outlined in this Agreement, you are strictly instructed to immediately terminate all usage of our digital platforms, cease participation in our programs, and refrain from utilizing our charitable or educational services.

SECTION 1:Preamble, Legal Acknowledgment & Binding Nature

  • Universal Electronic Contract

    This Master Legal Disclaimer and Terms of Use ("Agreement") constitutes a fully binding, legally enforceable contract between you (hereinafter referred to as the "User," "Participant," "Student," "Parent," "Legal Guardian," "Patient," "Beneficiary," "Donor," or "Visitor") and the Ramasukh Foundation of India (U.P.), Lucknow.

  • Absolute Assent

    By accessing, browsing, registering on, downloading from, or interacting in any manner with the official website, portals, or physical/virtual programs of the Foundation, you explicitly, unconditionally, and irrevocably agree to comply with and be bound by every term, condition, covenant, and disclaimer contained herein.

  • Inability to Opt-Out of Terms

    If you do not agree with any single clause, provision, or limitation outlined in this Agreement, you are strictly instructed to immediately terminate all usage of our digital platforms, cease participation in our programs, and refrain from utilizing our charitable or educational services.

SECTION 2:Comprehensive Definitions & Interpretation

  • Foundation

    Means the Ramasukh Foundation of India (U.P.), Lucknow, including all its trustees, executive officers, legal representatives, staff, volunteers, operational wings, and authorized affiliates.

  • Content

    Includes all text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, audio-visual materials, computer code, software architecture, curriculum outlines, question banks, and proprietary data hosted on our digital portals.

  • Services

    Encompasses all philanthropic, educational, competitive examinations (RNAIO), technological platforms, healthcare initiatives, senior care, child welfare, subsidized distribution drives, and animal rescue operations managed by the Foundation.

  • User

    Denotes any natural or legal person interacting with our platform, registering for any examination, making donations, or receiving charitable benefits.

SECTION 3:Absolute Limitation of Liability & Zero Financial Exposure

  • Comprehensive Liability Waiver

    To the absolute maximum extent permitted under applicable laws of the Republic of India, the Foundation, its trustees, officers, directors, employees, volunteers, agents, and technical vendors shall not be held liable for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages of any kind whatsoever (including, without limitation, loss of data, loss of profits, emotional distress, physical injury, or operational interruption).

  • Rigid Financial Liability Cap

    In the event that any court of law, consumer forum, or arbitral tribunal rules against the Foundation despite the explicit waivers herein, the total aggregate financial liability of the Foundation for any claim arising out of website usage, examination participation, charitable services, or program interaction shall be strictly, rigidly, and immutably capped at the exact administrative or registration fee paid by the user (with a maximum absolute limit of INR 500/-). If a service, examination trial, or welfare program is provided free of cost, the Foundation's liability shall be exactly INR 0 (Zero).

  • Third-Party Infrastructure Waiver

    The Foundation assumes zero legal or financial responsibility for vulnerabilities, security breaches, data leakage, payment failures, or technical downtime originating from third-party payment gateways, cloud hosting providers, internet service providers, or external communication networks.

SECTION 4:Exhaustive Indemnification & Hold-Harmless Mandate

You hereby agree to defend, indemnify, and hold harmless the Ramasukh Foundation of India (U.P.), Lucknow, its trustees, officers, employees, volunteers, agents, and assigns from and against any and all claims, demands, causes of action, losses, liabilities, damages, judgments, settlements, costs, or expenses (including actual legal fees, advocate retainers, and court costs) arising directly or indirectly out of:

  • Breach of Agreement

    Any breach, violation, or non-fulfillment of any provision of this Agreement by you.

  • Unauthorized Access

    Any unauthorized, fraudulent, or negligent use of your website credentials, account access, or examination portals.

  • Misconduct

    Any negligent, reckless, or intentional misconduct by you or any minor under your legal supervision or guardianship.

  • Third-Party Claims

    Any third-party claims, disputes, or legal actions resulting from interactions, transactions, or communications initiated by you through our digital platforms or physical facilities.

SECTION 5:Strict Non-Refundability, Financial Finality & Donations

  • Strictly Non-Refundable Fees

    All registration fees, portal access charges, administrative fees, testing fees, application processing charges, and institutional fees paid to the Foundation are strictly non-refundable under any and all circumstances.

  • Exclusion of Refund Claims

    No refunds, partial reimbursements, or fee transfers will be granted under any condition, including but not limited to: voluntary withdrawal, technical disqualification, exam absence, medical emergencies, scheduling conflicts, personal dissatisfaction, or cancellation of programs due to unforeseen events.

  • Irrevocability of Donations

    All monetary or in-kind charitable donations made to the Foundation are final, voluntary, and entirely irrevocable. Such funds are utilized exclusively at the absolute discretion of the Foundation management for registered social, educational, and philanthropic objectives.

SECTION 6:Examination, RNAIO, AI Proctoring & Disqualification Governance

  • Strict Automated & Manual Surveillance

    All competitive examinations, including the Ramasukh National AI Olympiad (RNAIO), are monitored continuously through advanced automated AI-proctoring systems backed by rigorous manual oversight.

  • Finality of Examination Committee Rulings

    All decisions, evaluations, scoring determinations, and disqualification rulings rendered by the RNAIO Examination Committee are final, binding, and completely exempt from appeal, review, or litigation.

Immediate Disqualification Triggers

  • Tab switching, minimizing the test window, or running background applications during the active exam session.

  • The presence of unauthorized individuals, unapproved physical notes, calculators, secondary digital devices, or unauthorized audio/voice inputs.

  • Obstructing, disabling, covering, or misaligning the active webcam feed during the examination period.

SECTION 7:Charitable, Healthcare, Ration & Welfare Services Disclaimer

  • Healthcare & Medical Services

    Medical camps, clinics, and health assistance provided by the Foundation are charitable and humanitarian in nature. The Foundation disclaims all liability for unforeseen medical complications, diagnostic inaccuracies, or treatment outcomes, and beneficiaries utilize medical services entirely at their own risk.

  • Sasta Pure Ration & Subsidized Distribution

    Distribution items under the Sasta Pure Ration initiative are procured and provided in good faith. The Foundation acts solely as a charitable facilitator and shall not be held liable for manufacturing defects, storage degradation, or consumption-related issues outside its direct operational control.

  • Welfare & Shelter Facilities (Old-Age, Orphanage, Animal Care)

    Admission and residence in our old-age homes, orphanages, or animal shelters are governed by strict internal institutional bylaws. The Foundation maintains the absolute right to deny entry, suspend, or expel any individual or animal violating institutional rules to safeguard general safety and operational integrity.

SECTION 8:Intellectual Property & Digital Asset Protection

  • Absolute Ownership

    All text, graphics, logos, trademarks, software code, database designs, curriculum structures, question banks, audio-visual assets, and structural designs on www.ramasukhfoundation.com are the exclusive intellectual property of the Foundation.

  • Prohibited Exploitation

    Any unauthorized copying, reproduction, distribution, reverse-engineering, data scraping, or commercial exploitation of the Foundation's intellectual property will invite immediate civil prosecution and criminal penalties under Indian copyright and information technology laws.

SECTION 9:Force Majeure & System Outage Exemptions

  • Exemption from Performance

    The Foundation shall not be deemed in breach of any contractual obligation, nor shall it be held liable for any failure or delay in executing programs, holding examinations, or delivering services caused directly or indirectly by events beyond its reasonable control (Force Majeure).

  • Included Force Majeure Events

    Force Majeure events include, but are not limited to: acts of God, natural disasters, epidemics, pandemics, government lockdowns, civil unrest, terrorist activities, cyber-attacks, distributed denial-of-service (DDoS) incidents, upstream internet backbone failures, electrical grid collapses, or judicial directives.

SECTION 10:Governing Law, Binding Arbitration & Exclusive Jurisdiction

  • Governing Law

    This Agreement and all legal relationships between the User and the Foundation shall be governed by, construed, and enforced strictly in accordance with the substantive and procedural laws of the Republic of India.

  • Mandatory Binding Arbitration

    Any dispute, controversy, claim, or difference arising out of or relating to this Agreement, website usage, examinations, or charitable programs shall be referred to and finally resolved by Binding Arbitration under the provisions of the Arbitration and Conciliation Act, 1996. The arbitration proceedings shall be conducted by a Sole Arbitrator appointed exclusively by the management of the Foundation, and the seat and venue of arbitration shall be Lucknow, Uttar Pradesh, India. The arbitration proceedings shall be conducted in English or Hindi.

  • Exclusive Judicial Jurisdiction

    For any matters permitted to escape arbitration, or for seeking interim injunctive relief, exclusive and special judicial jurisdiction shall vest solely and exclusively with the competent courts located in Lucknow, Uttar Pradesh, India, to the complete exclusion of all other courts nationwide or internationally.

SECTION 11:Miscellaneous Provisions (Severability & Entire Agreement)

  • Severability Clause

    If any provision, clause, or section of this Agreement is held to be invalid, illegal, or unenforceable by a competent court or arbitrator, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

  • Entire Agreement

    This document constitutes the entire, final, and complete agreement between the User and the Ramasukh Foundation of India (U.P.), Lucknow, superseding all prior or contemporaneous oral or written communications, proposals, representations, or understandings.

Mandatory User Declaration & Agreement

I hereby solemnly declare, warrant, and confirm that:

  • I am accessing the Foundation’s platforms and services of my own free will, sound mind, and without any coercion, fraud, or undue influence.
  • I clearly understand that fees paid to the Foundation are strictly NON-REFUNDABLE under any circumstances whatsoever, and that liability is capped at the fee paid (maximum ₹500/-) or ₹0 for free services.
  • I have read, understood, and unconditionally accepted all the Terms and Conditions, Master Legal Disclaimer, Liability Shield, Arbitration, and Jurisdiction clauses detailed above.
